ITC’s product is Mom’s Magic, and Britannia’s product is Good Day. Both are products of the butter biscuit category, and there is a dispute between the two companies.
Madras High Court Decision
Britannia alleges that ITC has copied the packaging of its butter biscuit product Mom’s Magic Butter Cookies from its popular product Good Day Butter Cookies. Britannia filed a case against ITC regarding this. While hearing the case, the Madras High Court ruled in favour of Britannia. The High Court banned ITC from packaging Mom’s Magic sold under the Sunfeast brand for copying the packaging of Good Day.
Ongoing Controversy Over Blue Packaging
Good Day’s blue packaging is quite popular in the market. Good Day’s brand identity has been somewhat established with blue packaging. ITC has also introduced Mom’s Magic in the market in blue packaging. The controversy is over this blue packaging. The High Court gave a decision to ITC to ban blue packaging for Mom’s Magic, which ITC challenged.
Now, The Hearing Will Be Held In January
Hearing this case, the Supreme Court bench led by Justice Sanjeev Khanna said that both companies make premium products consumed on a large scale. The bar said it would be better if both companies resolved the matter by talking to each other. After giving both companies instructions, the Supreme Court posted the case for hearing in January.
